1. Introduction & Acceptance

These Terms of Service ("Terms") govern your use of Kaptoria, an AI headshot generation service operated by Aevum Technology LTD, a company registered in England and Wales.

By accessing or using Kaptoria, you agree to be bound by these Terms. If you do not agree, you must not use our service. You must be at least 16 years old to use Kaptoria.

2. Service Description

Kaptoria provides an AI-powered professional headshot generation service. You upload photos, interact with an AI photographer through a chat interface, and receive AI-generated professional headshots. The service operates on a credit-based system — you purchase credits and use them to generate headshots.

3. Account Terms

  • You must provide accurate and complete information when creating your account.
  • You are responsible for maintaining the security of your account and password.
  • One account per person. Shared or automated accounts are not permitted.
  • You must notify us immediately of any unauthorised access to your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Credits & Payment

  • Credits are purchased through Stripe, our payment processor.
  • Credits that have been used for headshot generation are non-refundable.
  • Unused credits may be refunded within 14 days of purchase in accordance with the UK Consumer Rights Act 2015.
  • By purchasing credits, you acknowledge and consent to the immediate supply of digital content. For credits that are used, you agree that this waives the 14-day cooling-off period.
  • Prices may change with 30 days' notice. Previously purchased credits are not affected by price changes.
  • All displayed prices include applicable taxes.

5. Photo Upload & Processing

  • You warrant that you have the legal right to upload any photos you submit to our service.
  • You must not upload photos of other people without their explicit consent.
  • Original uploaded photos are deleted immediately after headshot generation completes. We do not retain your original photos.
  • We do not use your uploaded photos for AI model training or any purpose beyond generating your requested headshots.
  • Photos are processed using Google's GenAI SDK. Google's data usage terms for their GenAI API apply to this processing.

6. Intellectual Property

Your Content

You retain full ownership of the photos you upload. You also receive full rights to the AI-generated headshots you purchase, including commercial usage rights. You may use your purchased headshots for any lawful purpose.

Our Service

Kaptoria and Aevum Technology LTD retain all rights to the platform, technology, branding, design, and service. Nothing in these Terms grants you rights to our trademarks, brand features, or proprietary technology.

Limited License

By uploading photos, you grant us a limited, temporary, non-exclusive license to process your photos solely for the purpose of generating your headshots. This license expires immediately upon completion of the generation process.

7. Acceptable Use

You agree not to:

  • Upload illegal, harmful, or offensive content
  • Upload photos of others without their explicit consent
  • Attempt to reverse-engineer, copy, or extract our AI models or algorithms
  • Use automated tools, bots, or scripts to access the service without our written permission
  • Resell, sublicense, or redistribute the service without authorisation
  • Use the service for any purpose that violates applicable law

8. AI-Generated Content Disclaimer

  • AI-generated headshots may vary in quality and accuracy depending on the input photos and other factors.
  • We do not guarantee specific aesthetic outcomes or results.
  • AI-generated headshots are not photographs. Where required by applicable law, you should identify them as AI-generated content.
  • The service is provided "as is" with respect to output quality. We continuously work to improve results but cannot guarantee perfection.

9. Limitation of Liability

To the maximum extent permitted by law, our total liability to you for any claims arising from or related to your use of Kaptoria shall not exceed the total amount you have paid to us in the 12 months preceding the claim.

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, regardless of the cause of action.

Nothing in these Terms excludes or limits our liability for fraud, death or personal injury caused by our negligence, or any other matter that cannot be excluded or limited under the laws of England and Wales.

10. Termination

  • You may delete your account at any time through your account settings.
  • We may suspend or terminate your account for violations of these Terms, with reasonable notice where possible.
  • Upon termination, your generated headshots will remain available for download for 30 days, after which they will be deleted.
  • Unused credits at the time of account termination are refundable at their full value.

11. Governing Law & Disputes

These Terms are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over any disputes arising from these Terms.

If you are a consumer in the European Union, you retain the benefit of any mandatory provisions of the law of your country of residence.

12. Changes to These Terms

We may update these Terms from time to time. For material changes, we will provide at least 30 days' advance notice via email. Non-material changes take effect upon posting to our website.

Your continued use of the service after the notice period constitutes acceptance of the updated Terms. If you disagree with any changes, you may delete your account before the changes take effect.
